Florida is a permitless (constitutional) carry state as of July 1, 2023 (HB 543) — most adults 21+ who can lawfully possess a firearm may carry concealed without a license. The Concealed Weapon or Firearm License remains available and is worth holding for reciprocity. Under § 790.015, Florida Statutes, Florida recognizes out-of-state concealed-weapon licenses only from states that in turn honor the Florida license, and for several states only the resident license is recognized (non-resident licenses from those states are not honored).

Florida has permitless (constitutional) concealed carry since July 1, 2023 (HB 543). A person 21 or older who is not otherwise disqualified and who satisfies the eligibility criteria of § 790.06(2) may carry concealed without a license (§ 790.01(1), Fla. Stat.); residency is not required. A permitless carrier must carry valid identification and display it on an officer's demand. (A 2025 appellate ruling has been litigated over the 18-20 age line; the statute as written requires age 21 — operator should re-verify.)

Open carry
Permitless
Open carry became lawful in Florida in 2025: in McDaniels v. State (Sept. 10, 2025) the First District Court of Appeal held Florida's open-carry ban (§ 790.053, Fla. Stat.) unconstitutional, and the Attorney General issued statewide guidance directing non-enforcement of the ban. Open carry is therefore permitted for those who may lawfully carry, subject to the § 790.06(12) off-limits locations and the § 790.10 prohibition on displaying a firearm in a rude, careless, angry or threatening manner. (Recent change — operator should re-verify enforcement posture and any further appellate review.)

Duty to inform
Not required
Florida imposes no duty to proactively inform a law enforcement officer that you are carrying. A permitless concealed carrier must, however, carry valid identification and display it upon an officer's demand (§ 790.01, Fla. Stat.).
